Contest brought to you by Home Hardware Stores Limited ("HHSL" OR "Sponsor") with its head office located at 34 Henry St. W., St. Jacobs, Ontario N0B 2N0.. No purchase necessary. Contest is void in whole or part where prohibited by law. See eligibility section below for further details. To participate in the contest you must read and agree to these rules and regulations. Participation in the contest constitutes full and unconditional agreement and acceptance of these rules and Regulations (as the same may be amended by HHSL from time to time in its sole discretion). All dollar amounts are in Canadian funds ($CDN) unless otherwise noted. Toyota Canada is not a Sponsor or Co-Sponsor of this Contest.
1. CONTEST PERIOD:
The Home Hardware & Toyota Winter Giveaway (the "Contest") will begin on December 11th, 2017 at approximately 8:00 am EST and will end on February 14th, 2018, 11:59pm EST (the "Contest Period").
2. ELIGIBILITY:
Contest is open to all legal residents of Canada who have reached the legal age of majority in their province/territory of residence at the time of entry, except employees (and those with whom such employees are domiciled), shareholders or agents of Sponsor, the participating stores of Home Hardware, Home Hardware Building Centre, Home Building Centre and Home Furniture ("Stores"), and their advertising and promotional agencies ("Contest Parties"). This contest is not open to the employees and representatives of Toyota Canada, their agents, dealers, parent, affiliated or related companies, partners, or subsidiaries; as well as any person living in the same household as such persons

There is a limit of one entry per person/email address. Potential winners may be required to provide HHSL with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. Odds of winning depend upon the total number of eligible entries received during the contest period.
4. ELIGIBILITY REQUIREMENTS:
BY CLAIMING A PRIZE, YOU AGREE THAT YOU HAVE COMPLIED WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASEES (DEFINED BELOW) WILL BEAR NO LEGAL LIABILITY REGARDING THE USE OF YOUR ENTRY AND SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS SUBSEQUENTLY DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT FULLY COMPLIED WITH ANY OF THESE RULES.
5. PRIZE AND APPROXIMATE RETAIL VALUE:
Grand Prize:
(1) 2018 Toyota Corolla SE CVT with XSE Package, in Barcelona Red (the ‘Prize’).
There will be one (1) prize (the "Prize") available to be won consisting of a 2018 Toyota Corolla SE CVT with XSE Package in Barcelona Red with an approximate retail value of $25,870. Prize includes destination/freight charges and all applicable fees and taxes. Without limiting the generality of the foregoing, the following general conditions apply to the Prize: (i) Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion); (ii) no substitutions except at Sponsor's option; (iii) Sponsor reserves the right at any time to substitute the Prize or a component thereof for any reason with a prize or prize component(s) of equal or greater value, including, without limitation, but solely at the Sponsor's sole discretion, a cash award; (iv) colour and other specifics of the Prize will be at the sole and absolute discretion of the Sponsor and subject to availability; (v) manufacturer's standard warranty applies to the Prize; (vi) upon notification, the confirmed Prize winner will be required to personally take delivery of the Prize from a Toyota dealership within Canada reasonably close to his/her place of residence in Canada as determined by Sponsor, in its sole and absolute discretion, and will be required to present adequate personal identification (in a form acceptable to the Sponsor - including, without limitation, government issued photo identification); (vii) Prize will not be released unless and until the confirmed Prize winner first shows proof (in a form acceptable to the Sponsor) of having a valid driver's license (equivalent to a full "G" class license in Ontario) in the province/territory in which he/she resides and proof (in a form acceptable to the Sponsor) of satisfactory insurance; (viii) confirmed Prize winner is solely responsible for all expenses that are not included in the Prize description above, including, but not limited to, registration and license fees, insurance, additional accessories and all other costs associated with: (a) any upgrade or option package(s) that he/she may request (and that may be permitted by Sponsor in its sole and absolute discretion); (b) obtaining a valid driver's license, license plates, registration, insurance and/or fuel; and/or (c) taking delivery of the Prize.
The characteristics and features of each Prize element, unless otherwise explicitly described above, are at the Sponsor's sole discretion. No substitutions except at Sponsor's option. Any and all costs/expenses not specifically included in the Prize description are the sole and absolute responsibility of the confirmed winner.
6. WINNER SELECTION:
At 10:00am EST on February 27th , 2018 (the "Draw Date"), at 96 Spadina Avenue in Toronto, Ontario, the Grand Prize winner will be selected by random draw from amongst all eligible Entries submitted in accordance with these Rules (as determined by the Sponsor at its sole discretion).
The Sponsor or its designated representative will make a minimum two (2) attempts to contact the selected potential Prize winner within seven business days of the Draw Date. If a selected entrant cannot be contacted within seven business days of the Draw Date, or if there is a return of any notification as undeliverable; then he/she will be disqualified (and will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant).
BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each selected entrant will be required to (a) correctly answer a time limited mathematical skill testing question, and (b) sign and return within five (5) business days of notification the Sponsor's declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the HHSL, Toyota Canada, and each of their respective officers, directors, employees, agents, representatives, Dealers, successors and assigns (collectively, the "Releasees") from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If a selected entrant: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot (or is unwilling to) accept his/her Prize as awarded for any reason; then he/she will be disqualified (and will forfeit all rights to a Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining applicable eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant).
7. GENERAL CONDITIONS:
ANYONE DETERMINED BY THE SPONSOR TO BE IN VIOLATION OF THESE RULES FOR ANY REASON IS SUBJECT TO DISQUALIFICATION IN THE SOLE AND ABSOLUTE DISCRETION OF THE SPONSOR AT ANY TIME.
By participating in this Contest, each entrant: (i) agrees to be bound by these Rules; and (ii) releases the Releasees from any and all liability in connection with this Contest and his/her participation therein. All Entries become the property of the Sponsor.
The Releasees will not be liable for: (i) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; or (ii) the failure of any Entry to be received for any reason including, but not limited to, technical problems or traffic congestion on the Internet or at any website or mobile network.
The Sponsor reserves the right subject to the approval of the Régie de alcools, des courses et des jeux ("Régie"), to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. The Sponsor reserves the right, subject only to the approval of the Régie, to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.
This Contest is subject to all applicable federal, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants or Entries.
The Sponsor reserves the right, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason.
In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials including, without limitation, the French version of the Rules, the terms and conditions of these English Rules shall prevail, govern and control.
8. FOR QUEBEC RESIDENTS: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.
9. PRIVACY: By completing the entry form all entrants expressly consent to the collection, use and distribution of their personal information by the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry for the purpose of (i) running the Contest (ii) as permitted by these rules (for example, pursuant to these rules, all entrants who accept a prize consent to the use of their personal information for publicity usages including as permitted by any release signed) and (iii) provided the entrant opts in, to receive marketing and promotional information; in accordance with the Sponsor's privacy policy available at www.homehardware.ca and Toyota Canada's privacy policy (as applicable) available at https://www.toyota.ca/toyota/en/privacy#/al/toyota-privacy-content.
10. INTELLECTUAL PROPERTY
All intellectual property used by the Sponsor in connection with the promotion and/or administration of the Contest, including, without limitation, all trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned (or licensed, as the case may be) by the Sponsor and/or its affiliates. All rights are reserved. Unauthorized copying or use of any such intellectual property without the express written consent of its owner is strictly prohibited.
11. GOVERNING LAW
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or the rights and obligations of entrant and the Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario and the federal laws applicable therein without regard to Ontario conflicts of law principles. All entrants consent to the jurisdiction and venue of the Province of Ontario.
